Transfer pricing policy

Transfer pricing policy is best defined as a series of guidelines developed in a group of related entities, aimed at achieving specific economic goals related to the transfer of goods between the parties to the transaction.

The transfer pricing policy defines the current rules for making transactions. The main objective of the transfer pricing policy is to define consistent conditions for transactions between related entities and to define the transparency of the rules for their implementation. Therefore, it is crucial to properly define the categories of transactions occurring as part of the business activity and to determine for them rational and verifiable, but above all, market-based methods of remuneration calculation. Transactions based on the adopted transfer pricing policy are made on the basis of rational premises, with strictly defined conditions, where the method of determining and calculating the price for a given type of transaction is unchangeable and economically justified. The use of various calculation methods and the lack of a specific, conscious and formalized transfer pricing policy most often leads to an increase in tax risk as well as to distortion of financial results, and consequently to making wrong decisions based on distorted data.

Taking into account the changing legal standards both on a national and international scale, the development of a transfer pricing policy is a complex task, because the established procedures for intra-group settlements should ensure security and comfort not only in the scope of existing domestic and global regulations, but also in the event of their inevitable and expected changes in the near future

The team of PKF Tax&Legal experts offers you the opportunity to review your transfer pricing policy and assess whether the procedures indicated therein meet the requirements of the mandatory provisions of tax law and do not generate the risk of objections by the tax authorities.
